On enabling uniformity of measurements

Article 1. The subject of regulation of this Law

This Law establishes the legal framework for enabling traceability and uniformity of measurements in the Kyrgyz Republic and aims to achieve objective, reliable and comparable measurement results, to protect the rights and legitimate interests of citizens, individual entrepreneurs, legal entities and the state from consequences of unreliable measurement results.

Article 2. The main definitions used in this Law

State metrological supervision - an activity carried out by a government body authorized by the Government of the Kyrgyz Republic to verify compliance with mandatory requirements of regulatory legal acts in the field of enabling the uniformity of measurements;

Uniformity of measurements - state of measurements, in which their results are expressed in legal units of values or in values according to established measurement scales, while the indicators of measurement accuracy do not go beyond the established limits;

Regulatory metrology - a section of metrology related to activities concerning legal requirements with regard to measurements, units of measurement, measuring instruments and measurement methods;

Calibration of measuring instruments - a set of operations that establish the relationship between the values of quantities with measurement uncertainties that standards provide, and the corresponding readings of measuring instruments with their inherent uncertainties;

Metrological examination - analysis and assessment of correctness of the application of metrological requirements, rules and regulations primarily related to the uniformity and accuracy of measurements;

Metrology - the science on measurements, methods and means to enable their uniformity and ways to achieve the required accuracy;

Metrological traceability is a property of measurement result, according to which the result can be correlated with the basis for comparison through a documented continuous chain of calibrations (to the international SI system), each of which contributes to measurement uncertainty;

Measurement uncertainty - a non-negative parameter that characterizes dispersion of values assigned to measurable quantity based on the information used;

Calibration testing of measuring instruments - determining the suitability of a measuring instrument for use based on experimentally determined metrological characteristics and confirmation of their compliance with the mandatory requirements established by technical regulations or specified in the manufacturer documents;

Comparison of standards - comparison of unit values reproduced and / or stored by two or more standards;

Measuring instrument - a technical instrument intended for measurement that has established metrological characteristics;

Standard sample - a material that is sufficiently uniform and stable with respect to certain properties in order to use it when measuring or evaluating quality properties in accordance with the intended purpose;

Approval of measuring instruments type - a decision made by the national metrology authority stating that the type of measuring instrument meets the established requirements;

Standard - a measuring instrument designed to reproduce or obtain, store and transmit a unit of measurement or scale of measurement;

Basic reference standard - a standard with the highest metrological properties (in a country, region, organization, laboratory) and transmitting a unit of measurement or scale of measurements to subordinate standards and means of measurement;

National standard - a standard recognized by the state body responsible for enabling the uniformity of measurements for use in the state or economy as a reference for the country.

Article 3. The llegislation of the Kyrgyz Republic on uniformity of measurements 

The legislation of the Kyrgyz Republic on uniformity of measurements is based on the Constitution of the Kyrgyz Republic and consists of this Law and other regulatory legal acts adopted on the basis of this Law, as well as international treaties and agreements to which the Kyrgyz Republic is a party that entered into force in accordance with established legal procedure.

Article 4. State system for ensuring uniformity of measurements

1. The state system dealing with the uniformity of measurements is a set of rules for work on enabling the uniformity of measurements, its participants and the rules of functioning of the system of uniformity of measurements in general.

2. The scope of state regulation extends to measurements that are made when:

1) implementing activities in the field of health, veterinary medicine;

2) implementing activities in the field of environmental protection, traffic safety;

3) work to ensure safe labor conditions and protection;

4) implementing trade operations and mutual settlements between the manufacturer (seller) and the consumer (buyer);

5) rendering postal services and accounting for the volume of telecommunication services (connection duration and traffic volume);

6) carrying out activities in the field of mandatory technical regulation.

3. Participants of the state system for uniformity of measurements include the following:

 1) state body for uniformity of measurements;

2) national metrology authority;

3) state metrological supervision authority;

4) metrology units of legal entities.

4. The competence of the state body for uniformity of measurements, the national metrology authority and the state metrological supervision body is defined by the provisions approved by the Government of the Kyrgyz Republic.

5. When performing the work in state regulation area, creation of metrological services to ensure the uniformity of measurements is mandatory.

Article 5. Units of measurement

1. In the Kyrgyz Republic, the units of the International System of Units (SI), adopted by the General Conference on Weights and Measures, recommended by the International Organization of Legal Metrology (IOLM), decimal multiples and fractional SI units are used.

2. Names, designations, rules for writing and using units of measurement in the Kyrgyz Republic are established by the Government of the Kyrgyz Republic.

3. In the Kyrgyz Republic, special units of measurement are applied along with units of measurement of the International System of Units.

The rules for writing and using special units of measurement shall be established by the Government of the Kyrgyz Republic.

Article 6. National and reference standards of units

1. National standards of the Kyrgyz Republic are created for maintenance and dissemination of units of measurement approved for use in accordance with the needs of the Kyrgyz Republic related to its technical development. National standards are stored in the national metrology authority.

2. The reference standards of some units of physical quantities of the Kyrgyz Republic, which are stored in other organizations, are given the status of national standards in accordance with the procedure established by the Government of the Kyrgyz Republic.

3. The procedure for approval of national and reference standards of units, maintaining the state register of national standards is established by the Government of the Kyrgyz Republic.

The list of national standards is established by the Government of the Kyrgyz Republic.

4. National standards of the Kyrgyz Republic are the property of the Kyrgyz Republic and are not subject to privatization.

Article 7. Specialized tests

1. In areas where traceability cannot be achieved through standards, specialized testing laboratories are established under the national metrology authority.

2. The procedure for creation and operation of specialized laboratories shall be established by the Government of the Kyrgyz Republic.

Article 8. Measuring instruments

1. Measuring instruments are used to determine the values, the units of which are authorized for use in accordance with established procedure in the Kyrgyz Republic.

2. Measuring instruments include measures, measuring instruments, measuring systems and complexes, as well as other devices that perform measuring functions.

The decision to classify a technical device as a measuring instrument is taken by the national metrology authority.

3. On the territory of the Kyrgyz Republic, when measuring is related to state regulation, tested measuring instruments of the approved type must be used.

Article 9. Approval of the type of measuring instruments and reference materials 

1. Measurement instruments and reference materials manufactured in the Kyrgyz Republic or imported into the territory of the Kyrgyz Republic for use in the areas of state regulation are subject to type approval prior to their release in circulation.

2. Recognition of measuring instruments test results and approval of the type of measuring instruments and reference materials produced in foreign countries is carried out based on relevant international agreements to which the Kyrgyz Republic is a party.

3. The procedure for approving the type and application of the approval mark of the type of measuring instruments and reference materials, maintaining the state register of measuring instruments and reference materials is established by the Government of the Kyrgyz Republic.

Article 10. Calibration test of measuring instruments

1. Measuring instruments used in the field of state regulation are subject to primary and subsequent (periodic) calibration tests.

2. The national metrology authority makes calibration tests of measuring instruments.

In the absence of relevant standards in the national metrology authority, calibration tests of measuring instruments is carried out by legal entities authorized in accordance with the procedure established by the Government of the Kyrgyz Republic.

3. Specialists performing calibration test of measuring instruments are subject to certification as calibration officers in accordance with the procedure established by the Government of the Kyrgyz Republic.

4. The procedure for calibration test, manufacture, use and storage of verification marks, the list of measuring instruments to be calibrated, and frequency of calibration of measuring instruments is established by the Government of the Kyrgyz Republic.

Article 11. Metrological examination

1. Draft technical regulations and other regulatory legal acts that contain requirements for enabling the uniformity of measurements are subject to mandatory metrological examination.

2. The procedure for metrological examination is established by the Government of the Kyrgyz Republic.

3. Outside the purview of state regulation, a metrological examination of standards, design, construction, technological documentation, measuring instruments and other objects can be carried out voluntarily.

Article 12. Testing of measuring instruments and (or) certification of reference materials for the purpose of type approval and (or) calibration of measuring instruments

1. Testing of measuring instruments and reference materials for the purpose of approving the type of measuring instruments is carried out by the national metrology authority.

2. For certain types of measurements, in the absence of relevant standards in the national metrology authority, it is allowed to delegate the right to conduct testing of measuring instruments to legal entities in order to approve the type and (or) make calibration of measuring instruments in accordance with the procedure established by the Government of the Kyrgyz Republic.

3. The procedure for granting and revoking the right to conduct testing of measuring instruments and (or) certification of reference materials for the purpose of approving the type and (or) calibration of measuring instruments to legal entities is established by the Government of the Kyrgyz Republic.

Article 13. Measurement routine

1. When performing calibration of measuring instruments, measurement procedures should be mandatory.

2. Outside the purview of state regulation, on a voluntary basis, certified measurement methods can be applied, as well as the ones developed by legal entities and individual entrepreneurs.

Article 14. Calibration of measuring instruments

1. To ensure metrological traceability in the field of mandatory technical regulation, calibration of measuring instruments should be carried out.

2. Calibration of measuring instruments should be performed by the national metrology authority, and by metrology units of legal entities accredited in accordance with the procedure established by the Government of the Kyrgyz Republic.

3. Calibration of measuring instruments should be performed using standards of measurement units traced to the International System of Units SI, through national and reference standards of the Kyrgyz Republic or standards of other states.

Article 15. State metrological supervision

1. State metrological supervision is implemented in the field of state regulation.

2. The procedure for conducting state metrological supervision is established by the Government of the Kyrgyz Republic.

Article 16. Responsibility for violations of the provisions of this Law

State bodies, legal entities and individual entrepreneurs found guilty of violating the provisions of this Law, shall bear criminal, administrative or civil liability in accordance with the legislation of the Kyrgyz Republic.

Article 17. State funding of works related to uniformity of measurements 

The following are funded from the republican budget:

1) works on creation, storage and improvement of the national reference base, ensuring the uniformity of measurements in the Kyrgyz Republic 

2) works aimed at achieving and maintaining international recognition of national standards, calibrations and measurements performed in the Kyrgyz Republic;

3) calibration or calibration test of national standards;

4) conduct of state metrological supervision;

5) maintaining the State Register of Measuring Instruments and Reference Materials;

6) research works in the field of metrology;

7) participation in comparisons of standards at the international, regional and national levels;

8) acquisition and development of equipment, premises necessary for maintenance of national and reference standards of the Kyrgyz Republic;

9) payment of contributions and participation in international (regional) metrology organizations, the list of which is determined by the Government of the Kyrgyz Republic. 

Article 18. Payment for metrological works and services

Metrological works and services provided by the national metrology authority, legal entities and individual entrepreneurs to business entities are paid by interested parties in accordance with the legislation of the Kyrgyz Republic and the terms and conditions of the contracts concluded.

Article 19. Transitional provisions

Documents in the field of uniformity of measurements issued in accordance with established procedure by the National Institute of Standards and Metrology of the Kyrgyz Republic and the authorized body for metrology of the Kyrgyz Republic before the entry into force of this Law shall be valid until the end of their validity period.

Article 20. Entry of this Law into force

1. This Law enters into force on the day of its official publication.

2. The Government of the Kyrgyz Republic, within six months, shall bring its regulatory legal acts in compliance with this Law.

3. From the day on which this Law enters into force, the following shall become invalid:

- The Law of the Kyrgyz Republic “On ensuring the uniformity of measurement” as of August 10, 2007 No. 149 (Bulletin of the Parliament of the Kyrgyz Republic, 2007, No. 7-9, p.718);

- The Law of the Kyrgyz Republic “On amendments and addenda to the Law of the Kyrgyz Republic “On ensuring the uniformity of measurement” as of May 29, 2012 No. 71 (Bulletin of the Parliament of the Kyrgyz Republic, 2012, No. 5, p. 2295).
