THE RESOLUTION OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

On authorized state bodies for implementation of state control (supervision) over compliance with the requirements of technical regulations of the Customs Union 

(As amended by the Resolutions of the Government of the Kyrgyz Republic as of November 18, 2015 N 780, February 22, 2018 N 107)

To identify the authorized state bodies for implementation of state control (supervision) over compliance with the requirements of the technical regulations of the Customs Union, in accordance with Articles 10 and 17 of the Constitutional Law of the Kyrgyz Republic “On the Government of the Kyrgyz Republic”, the Government of the Kyrgyz Republic resolves:

1. To establish that the state control (supervision) over compliance with the requirements of the technical regulations of the Customs Union shall be carried out by the following authorized state bodies:

a) The State Inspectorate for Environmental and Technical Safety under the Government of the Kyrgyz Republic shall control compliance with the requirements of the technical regulations of the Customs Union:

- on safety of pyrotechnic products (TRCU 006/2011);

- on safety of machinery and equipment (TRCU 010/2011);

- on safety of gas fuel operated machines (TRCU 016/2011);

- on safety of equipment operated in explosive environments (TRCU 012/2011);

- lift safety (TRCU 011/2011);

- on safety of small vessels (TRCU 026/2012);

- on safety of equipment operated under excessive pressure (TRCU 032/2013);

- on requirements for lubricants, oils and special fluids (TRCU 030/2012);

- on requirements for automotive and aviation gasoline, diesel and marine fuel, jet fuel and black oil fuel (TRCU 013/2011);

- on low-voltage equipment safety (TRCU 004/2011);

- electromagnetic compatibility of technical equipment (TRCU 020/2011);

- on safety of railway rolling stock (TRCU 001/2011);

- on railway infrastructure safety (TRCU 003/2011);

- on safety of wheeled vehicles (TRCU 018/2011);

- on safety of motor-roads (TRCU 014/2011);

- on safety of agricultural and forestry tractors and trailers (TRCU 031/2012);

- on the safety of explosives and explosive-based products (TRCU 028/2012);

- requirements for liquefied petroleum gases for use as fuel (TR EAEU 036/2016);

- on restricted use of hazardous substances in electrical and electronic products (TR EAEU 037/2016);

- on amusement ride safety (TR EAEU 038/2016);

- on safety of equipment for children's playgrounds (TR EAEU 042/2017);

- on requirements for fire safety and fire extinguishing devices (TR EAEU 043/2017).

b) The State Inspectorate of Veterinary and Phytosanitary Safety under the Government of the Kyrgyz Republic shall control compliance with the requirements of technical regulations of the Customs Union:

- on grain safety (TRCU 015/2012);

- on safety of milk and dairy products (TRCU 033/2013), in terms of epizootic well-being;

- on safety of meat and meat products (TRCU 034/2013), in terms of epizootic well-being;

- on mineral fertilizer requirements (TR EAEU 039/2016);

- on safety of fish and fish products (TR EAEU 040/2016), in terms of epizootic well-being.

c) The Department of Disease Prevention and State Sanitary and Epidemiological Surveillance of the Ministry of Health of the Kyrgyz Republic shall control compliance with the requirements of the technical regulations of the Customs Union:

- on safety of personal protective equipment (TRCU 019/2011);

- on packaging safety (TRCU 005/2011);

- on safety of products intended for children and adolescents (TRCU 007/2011);

- on safety of toys (TRCU 008/2011);

- on safety of perfumery and cosmetic products (TRCU 009/2011);

- on safety of light industry products (TRCU 017/2011);

- on food safety (TRCU 021/2011);

- food products in terms of their labeling (TRCU 022/2011);

- technical regulations for fruit and vegetable juice products (TRCU 023/2011);

- technical regulations for oil and fat products (TRCU 024/2011);

- on safety of certain types of specialized food products, including dietary therapeutic and dietary preventive nutrition (TRCU 027/2012);

- safety requirements for food additives, flavors and technological aids (TRCU 029/2012);

- on safety of furniture products (TRCU 025/2012);

- on safety of milk and dairy products (TRCU 033/2013);

- on safety of meat and meat products (TRCU 034/2013);

- on tobacco products (TRCU 035/2014);

- on safety of fish and fish product (TR EAEU 040/2016);

- on chemical product safety (TR EAEU 041/2017);

- on safety of packaged drinking water, including natural mineral water (TR EAEU 044/2017).

2. Authorized state bodies defined by this Resolution shall:

- on quarterly basis submit to the Ministry of Economy of the Kyrgyz Republic the information on the availability of circulation of products that do not meet the requirements of the technical regulations of the Customs Union in the Kyrgyz Republic, as well as the results of review of checked conformity certificates or declarations of conformity in a single form regarding their authenticity and compliance with the procedures for confirming compliance, testing, control, and procedures for accepting the declarations.

3. This Resolution shall enter into force on the date of entry into force of the Treaty on accession of the Kyrgyz Republic to the Treaty on the Eurasian Economic Union as of May 29, 2014.

4. The Ministry of Health of the Kyrgyz Republic, the State Inspectorate for Environmental and Technical Safety under the Government of the Kyrgyz Republic, the State Inspectorate for Veterinary and Phytosanitary Safety under the Government of the Kyrgyz Republic in accordance with established procedure shall submit draft regulations arising from this Resolution for consideration by the Government of the Kyrgyz Republic.

5. To publish this Resolution in the official media.

6. Control over the execution of this Resolution is assigned to the relevant departments of the Government Office of the Kyrgyz Republic.
