THE RESOLUTION OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

On mandatory confirmation of product conformity

The Resolution of the Government of the KR as of March 6, 2013 N 122 introduced changes to the wording of this Resolution is state language

In order to implement the Law of the Kyrgyz Republic “On the Fundamentals of Technical Regulation in the Kyrgyz Republic” and the Decree of the President of the Kyrgyz Republic “On State Policy in the Field of Creating a Favorable Investment Environment” as of October 7, 2004 N 331, the Government of the Kyrgyz Republic resolves:

1. Establish that:

- Before coming into force of technical regulations for products that are in circulation on the market in the Kyrgyz Republic, only mandatory requirements will apply contained in the regulatory legal acts of the Kyrgyz Republic and (or) standards (hereinafter referred to as the mandatory requirements) that regulate the minimum necessary standards in order to ensure safety and protection of human life and health, life and health of animals and plants, environmental protection;

- Mandatory confirmation of conformity of products will be carried out only for compliance with the mandatory requirements included in the List of products subject to mandatory confirmation of conformity.

2. Prior to adoption of technical regulations, approve the attached:

- List of products subject to mandatory confirmation of conformity;

- Regulations on the rules and procedures for mandatory certification of products.

3. The Ministry of Economic Development and Trade of the Kyrgyz Republic should:

- before March 1, 2008, develop and submit, in accordance with established procedure, draft Resolutions of the Government of the Kyrgyz Republic on approval of:

f) forms of the certificate of conformity upon mandatory confirmation of conformity, copies of the certificate of conformity and the annex to the certificate of conformity;

b) mark of compliance with technical regulations (mandatory requirements of regulatory legal acts and (or) standards - until adoption of technical regulations);

c) amendments and addenda to the List of products subject to mandatory confirmation of conformity in relation to products subject to declaration.

Changes to paragraph 3 in relation to changing the wording “The Ministry of Industry, Trade and Tourism” to replace by the wording “The Ministry of Economic Development and Trade” adopted by the Resolution of the Government of the KR as of October 23, 2007 N 512 duplicate the changes approved by the Resolution of the Government of the KR as of August 27, 2007 N 377

4. To establish that before approving the form of a certificate of conformity upon mandatory confirmation of conformity and a mark of conformity to technical regulations, the form of a certificate of conformity will be applied given in Appendix N 5 to the Regulations on the Rules and Procedures for Mandatory Certification of Products, and the national mark of conformity, the design and description of which are approved by the Resolution of the Government of the Kyrgyz Republic as of January 2, 1995 N 3 “On approval of the design of the mark of conformity of the national certification system”.

5. The Ministry of Health of the Kyrgyz Republic within three months from the date of publication of this Resolution should revise in accordance with established procedure the Resolution of the Government of the Kyrgyz Republic as of June 6, 2003 N 329 “On sanitary and epidemiological control to ensure sanitary and epidemiological well-being of the population by the bodies and institutions of sanitary-epidemiological service of the Kyrgyz Republic” to bring the Regulations on the procedure for sanitary-epidemiological examination of products according to the indicators of safety for human health, the List of products subject to sanitary and epidemiological examination on indicators of safety for human health and the Procedure for recognizing the results of sanitary and epidemiological (hygienic) conclusion for products on indicators of safety for human health in accordance with this Resolution.

6. (Repealed in accordance with the Resolution of the Government of the Kyrgyz Republic as of December 2, 2015 № 815)

7. Accredited bodies for mandatory product certification should:

- within four months from the date of adoption of the Resolution, bring all procedures for conducting mandatory certification of products in accordance with this Resolution, as well as revise price lists for certification and testing of products and approve them in accordance with established procedure;

- carry out mandatory certification of products in accordance with the Regulations on the rules and procedures for conducting mandatory certification;

- arrange for accounting of certificate of conformity forms, copies of certificates of conformity and holographic stamps with the image of the mark of conformity;

- on monthly basis submit data of the registers of certified products and information on cases of violations of mandatory safety requirements by applicants to the authorized body for technical regulation.

8. The Ministries, state committees, administrative departments, other executive authorities, local state administrations shall bring their regulatory legal acts in accordance with this Resolution within 6 months from the date of its adoption.

8.1. The Ministry of Internal Affairs of the Kyrgyz Republic shall carry out state registration and record technical inspections at the State Automobile Inspectorate of the Ministry of Internal Affairs of the Kyrgyz Republic of vehicles converted into public passenger vehicles of small capacity of categories M2 and M3 (up to 22 people) only after checking for compliance with the requirements of section 5 GOST R 41.52-2005 (UNECE Regulations N 52) “Uniform requirements for small capacity vehicles of category M2 and M3 in relation to their overall construction”, with the exception of paragraphs 5.1, 5.4, 5.5.1-5.5.5, 5.5.9, 5.6.5, 5.6.6, 5.6.10, 5.7.6, 5.9.4, 5.13.

9. The following to recognize repealed:

- the Resolution of the Government of the Kyrgyz Republic as of December 28, 2000 N 760 “On the list of types of products subject to mandatory certification against safety indicators”;

- paragraph 3 of the Resolution of the Government of the Kyrgyz Republic as of August 20, 2001 N 463 “On amendments and additions to certain decisions of the Government of the Kyrgyz Republic on agrarian sector issues”;

- the Resolution of the Government of the Kyrgyz Republic as of March 11, 2002 N 130 “On additions to the Resolution of the Government of the Kyrgyz Republic as of December 28, 2000 N 760 “On the list of types of products subject to mandatory certification against safety indicators”;

- the Resolution of the Government of the Kyrgyz Republic as of October 12, 2002 N 700 “On additions to the Resolution of the Government of the Kyrgyz Republic as of December 28, 2000 N 760 “On the list of types of products subject to mandatory certification against safety indicators”;

- the Resolution of the Government of the Kyrgyz Republic as of November 17, 2003 N 723 “On amendments and additions to certain decisions of the Government of the Kyrgyz Republic;

- the Resolution of the Government of the Kyrgyz Republic as of October 21, 2002 N 708 “On preparation for the introduction of the New Approach or Global Approach of the European Union providing for the CE marking”.

10. This Resolution shall enter into force three months from the date of its publication in mass media”.

11. Control over the implementation of this Resolution shall be entrusted to the Ministry of Economic Development and Trade of the Kyrgyz Republic.
