THE RESOLUTION OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

On the procedure for importation of products subject to mandatory confirmation of conformity for circulation in the territory of the Kyrgyz Republic, and on recognition of the results of mandatory confirmation of conformity of products obtained outside the Kyrgyz Republic

To implement the Law of the Kyrgyz Republic “On the Fundamentals of Technical Regulation in the Kyrgyz Republic”, the Government of the Kyrgyz Republic resolves:

1. To approve the attached:

- The procedure of importation of products subject to mandatory conformity into the territory of the Kyrgyz Republic;

- The procedure on recognition of the results of mandatory confirmation of conformity of products obtained outside the Kyrgyz Republic.

2. Authorized bodies implementing control over compliance with safety measures in the field of veterinary medicine, plant quarantine, epidemiology, sanitation (in terms of radiological safety) and environmental safety shall carry out their activities to control imported products at checkpoints across the state border of the Kyrgyz Republic in accordance with the legislation of the Kyrgyz Republic.

3. The national accreditation authority, on quarterly basis shall submit to the State Customs Committee of the Kyrgyz Republic, other state executive bodies, legal entities and individuals the information about the accredited certification bodies for products by publishing information in mass media.

4. The State Customs Committee of the Kyrgyz Republic on a monthly basis, by the 20th day of the month following the reporting month, shall submit to the authorized technical regulation body the information on imported products subject to mandatory confirmation of conformity released for free circulation.

5. To introduce amendments to the Resolution of the Government of the Kyrgyz Republic as of December 28, 2004 N 961 “On measures to implement the requirements of the Customs Code of the Kyrgyz Republic” to add the following:

- to add the paragraphs of the following wording to item 3:

“The customs authorities when making customs clearance of products intended for free circulation should be guided by the procedure for importing products intended for free circulation into the territory of the Kyrgyz Republic subject to mandatory conformity confirmation approved by the Resolution of the Government of the Kyrgyz Republic "On the procedure of importation of products for free circulation and recognition of the results of mandatory conformity assessment of products obtained outside the Kyrgyz Republic”.

Customs authorities shall not be entitled to require submission of certificates of conformity for products exported from the Kyrgyz Republic”.

6. To repeal the following:

- The Resolution of the Government of the Kyrgyz Republic as of April 23, 2002 N 242 “On approval of the procedure for recognition of documents confirming safety of products subject to mandatory control when imported into the Kyrgyz Republic”;

- The Resolution of the Government of the Kyrgyz Republic as of September 19, 2002 N 632 “On simplification of the procedure for control of products imported into the territory of the Kyrgyz Republic according to safety indicators”;

- paragraphs 4 and 5 of the Resolution of the Government of the Kyrgyz Republic as of April 10, 2003 N 203 "On measures to improve provision of medicines to the population”;

- paragraph 2 regarding the Department of Drug Supply and Medical Equipment of the Ministry of Health of the Kyrgyz Republic, paragraph 4 for the State Agency of Communications under the Government of the Kyrgyz Republic regarding the Register of permits issued by the executive authorities and their structural subdivisions approved by the Government of the Kyrgyz Republic as of February 25, 2004 N 103.

7. To establish that this Resolution shall enter into force three months from the date of its publication in the media.

8. Control over enforcement of this Resolution shall be entrusted to the Ministry of Economic Development and Trade of the Kyrgyz Republic.
